Terms

1. Contract of hire

All bookings are ratified by the owners and are subject to the following conditions which are deemed to be accepted in full by the hirer and all persons in the party on completion of the booking form.

2. Confirmation

Your booking is only confirmed on receipt of your deposit as per clause 3 of these conditions.

3. Payment

Your booking must be accompanied by your payment of 30% of the total cost. The balance, without further notice must be paid a clear 12 weeks prior to arrival. If your booking is made 12 weeks or less before arrival date it must be accompanied by full payment. If the final payment is not received by a clear 12 weeks prior to arrival then the owner will consider the hirer in breach of contract thereby cancelling the booking.

4. What is included

The villa rental includes the cost of water, gas, swimming pool and garden maintenance, and a full inventory of equipment and utensils. Regarding linen and towels, a fee is charged per set supplied, per person most villas also have a washing machine to refresh linen. You can order extra changes of linen you require to your booking at the same cost per person per set. You also have the option of bringing your own linen at no extra cost on your booking. Cleaning fee is set at a price per villa for cleaning the villa when you leave. This is compulsory. Extra cleaning can be ordered when booking to suit your needs at the same rate as displayed on each description. No items must be removed from the villa during your stay, and towels or other items from the villa must not be taken to the beach.

5. What is not included

The villa rental price does not include any personal insurance, travel, or transportation. Transport between the villa and airport is not provided.

6. Cancellation by hirer

Cancellation of the booking must be in writing and received by the owners a minimum of 12 clear weeks prior to the rental period. If cancellation is prior to this deadline the deposit only will be forfeited. If cancellation is less than 12 clear weeks before departure, the full hire cost is to be paid as laid down in clause 3.

7. Occupation

Only persons listed on the booking form may occupy the villa. The villa cannot be re-let or sublet without the written consent of the owner.

8. Damage to villa

Except in the case of normal wear and tear, the hirer will be responsible for making good any damage to the villa or its contents which has occurred as a result of negligence, wilful damage or irresponsible behaviour on the part of those occupying the villa or their guests. Such damage must be reported without delay to our representative. The cost of the repair or replacement must be agreed with and paid for to the representative or owners. A figure of £200/£300 depending on occupancy is held against damages or excessive cleaning requirements.

9. Hirer’s responsibilities

The hirer is responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils and furniture etc, must be left clean and tidy at the end of the hire period. The hirer shall ensure that no member of the party engages in any activity around the swimming pool that could cause pollution to the water or damage to the structure or filtration system, and ensure that the barbeque is cleaned, and that all rubbish is placed in the communal dustbins at the end of the road. Rubbish that has not been removed from the villa will incur a removal charge.

10. Rights of access

The representative or their agents have right of access to the property at any time with due regard to the convenience of the hirer for the purpose of inspection and maintenance.

11. Responsibilities

Neither the owners nor their agents can be held responsible for any circumstance beyond their control including but not limited to mechanical breakdown, illness or failure of any public service supply. The hirer responsible for booking undertakes that no person will suffer anything to be done which could endanger the policy of the villa owners insurers in respect of the villa and its contents which might make the same void or void-able.

12. Injury and damage

Neither the owners or their agents take any liability for personal injury, loss or damage to personal effects howsoever arising during the booking period.

13. Maximum number of persons

Under no circumstances may more than the maximum number of persons specified in the villa description occupy the villa without the written consent of the owners. The owners or their agents reserve the right to refuse admittance to the villa to the hirer and their party if they are in breach of this clause.

14. Information

All information supplied by the owner and their agents is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of statements made, but the owners or agents are not liable for any variation however caused.

15. Occupancy

The villa will be available for occupation from 17.00 hrs on the day of arrival and must be vacated by 10.00 hrs on the day of departure. Booking periods run from Saturday to Saturday unless otherwise arranged.

16. Keys

Detailed instructions for key collection and directions to the villa will be sent after receipt of final payment.

17. Complaints

The private owner is responsible for supplying the property in the correct condition for each Holiday client. Any complaints about the villa or its contents must be made in writing immediately to the owner/agent who will take all reasonable steps to remedy the problem. Neither the owners or their agents shall have any liability for any complaint submitted after the completion of the hire period. The Agent is not liable for any delays due to technical service enginers required. Complaints must be put in writing and handed to the agent in person immediatley, for them to remedy. Javea Rentals pass any complaints that can not be remedied to the owner.

18. Insurance

The villa hire cost does not include any personal insurance cover of any kind, including for cancellation.

Extra charges are displayed on the booking form (change on damage deposit ) £200, £300 or higher if single young groups, or larger groups.

Javea Rentals acts as an advertising agent for individual holiday property owners. If the private owner changes information, Javea Rentals will inform you as soon as possiable. We will only offer alternative accommodation or your money back. By renting a property listed on this website, you agree to the terms contained in this disclaimer.

IT IS A CONDITION OF THE BOOKING THAT INSURANCE IS TAKEN OUT AGAINST CANCELLATION AND IT IS STRONGLY RECOMMENDED THAT PERSONAL ACCIDENT INSURANCE AND MEDICAL INSURANCE IS ALSO TAKEN OUT.
